Court: Mud buggy race operators weren't negligent in crash

A jury properly determined that the operators of an Eau Claire mud buggy race weren't negligent in a wild crash that cost a spectator part of his leg, a Wisconsin appeals court ruled Tuesday.
The case revolves around Shawn Wallace, who was watching a race at Eau Claire's Pioneer Park in 2012 when a buggy hit a guardrail, flew off the track and landed in the crowd. Wallace was injured so badly he had to have one of his legs amputated below the knee.
He filed a lawsuit in 2013 alleging that the track's owner, Chippewa Valley Antique and Engine Model Club Inc., and the race's sanctioning body, Central Mudracing Association Inc., had been negligent.
The jury at the 2016 trial found that the accident was unforeseeable and that neither defendant had been negligent.
Wallace appealed, arguing that Eau Claire County Circuit Judge William Gabler had improperly barred him from telling the jury about a 2005 crash at the track that injured spectators and had improperly limited a crash reconstruction expert's testimony.
The 3rd District Court of Appeals sided with the judge. The court said in its ruling Tuesday that Gabler reasonably determined that the 2005 crash wasn't similar to the 2012 incident.
The earlier crash occurred on a different part of the track, the spectators who were injured were viewing the race from a truck, not the bleachers, and the track operators extended guardrails following that crash, the appeals court noted. Therefore the crash was of little value in Wallace's case, the court concluded.

Audit: 'Pervasive lack of accountability' in Kentucky courts

In 2016, Kentucky's Administrative Office of the Courts was looking for office space for newly-elected Supreme Court Justice Sam Wright. They got two offers: One would cost more than $59,000 a year and require extensive renovations. The other space was larger, had 15 parking spaces and would cost $21,000 a year.
State officials chose the first option, even though it cost three times as much. They did not document why they chose it, and they did not visit the site before signing the lease, as state policy requires. The selection memo, which is the sole document relied on to make the decision, also left out one key detail: The company that owned the more expensive property was owned by the justice's two sons.
That's just one finding of many in a scathing audit released Thursday of the administrative arm of Kentucky's judicial system. The audit, believed to be the first ever independent examination of judicial system's finances and policies, found a "pervasive lack of accountability" and resistance to transparency. The Supreme Court sets administrative policy for the judicial branch, but they meet in secret and won't allow the public to monitor their actions. When Auditor Mike Harmon recommended they conduct administrative business in public, they refused.
"Their dismissive attitude towards key recommendations regarding ethics and accountability quite frankly saddens me," Harmon said in a news release announcing the audit's findings. "No matter what branch of government, we owe it to the taxpayers of Kentucky to strive toward openness and transparency."

President Donald Trump is promising to select a "great" Supreme Court nominee to fill the vacancy of retiring Justice Anthony Kennedy
The president said Tuesday at a "Salute to Service" dinner in West Virginia that he "hit a home run" with Justice Neil Gorsuch, whom he picked for the nation's high court last year. Trump says, "We're going to hit a home run here."
Trump spoke to three potential Supreme Court nominees Tuesday before departing the White House.
On Monday, the president interviewed federal appeals judges Raymond Kethledge, Amul Thapar, Brett Kavanaugh and Amy Coney Barrett. That's according to a person with knowledge of the meetings who was not authorized to speak publicly about them.
The White House says President Donald Trump spoke Tuesday to three potential Supreme Court nominees.
White House spokesman Raj Shah disclosed the conversations. He did not detail with whom Trump had spoken Tuesday or say how many potential nominees Trump has now interviewed.
Trump has said he'll announce his pick July 9 and will chose from a list of 25 candidates.

Spanish court nixes terrorism accusation in Basque incident

Spain's National Court has sentenced seven men and a woman to between two and 13 years in prison for beating up two police officers and their girlfriends, but rejected the prosecutors' argument that the defendants should face terror charges.
The call for terror charges caused outrage at the trial because the incident took place two years ago in an area of northern Spain with a strong Basque identity.
The Basque region is trying to put behind it decades of violence at the hands of armed separatist group ETA, which killed more than 800 people, including police, before giving up its armed campaign in 2011.
The court said in sentencing Friday that terrorist intent was not proven and that the accused did not belong to a terrorist organization.

Court: US anti-discrimination law covers sexual orientation

A New York federal appeals court says U.S. anti-discrimination law protects employees from being fired due to sexual orientation.
The 2nd U.S. Circuit Court of Appeals ruled Monday. The decision stemmed from a rare meeting of the full appeals court, which decided to go against its precedents.
Three judges dissented. The ruling pertained to a skydiver instructor who said he was fired after telling a client he was gay.
The case led to two government agencies offering opposing views. The Equal Employment Opportunity Commission said Title VII of the 1964 Civil Rights Act covers sexual orientation. The Department of Justice had argued that it did not.
Donald Zarda was fired in 2010 from a skydiving job in Central Islip (EYEl-slihp), New York. He has since died. |
