Despite court ruling, China gay rights movement makes gains

For years, Chen Tiantian could only read about the gay rights movement in faraway places. She knew that there were activists in Beijing and a vibrant community in Shanghai, and that in San Francisco, a distant mecca, gay pride parades took up entire streets.
But on Wednesday, the 20-year-old English major sat on the steps of a courthouse and spoke fervently about how the struggle for equality had arrived in her central Chinese hometown — and how she planned to take part.
"It's hard to believe, but we're right in the middle of this," said Chen, who is lesbian and came with several friends to support a local couple who had challenged the city's civil affairs bureau after they were denied a marriage certificate. "It's like I'm finally entering the struggle myself."
Though it was dismissed by the court in Changsha, China's first legal challenge to a law limiting marriage to opposite-sex couples has galvanized many of the hundreds of young Chinese gay rights supporters who gathered at the courthouse, some of them waving small rainbow flags. The hearing's sizable public turnout and coverage by usually conservative Chinese media appeared to reflect early signs of shifting social attitudes in China on the topic of sexual orientation.
The lawsuit that was dismissed was brought by 26-year-old Sun Wenlin against the civil affairs bureau for refusing to issue him and his partner, Hu Mingliang, a marriage registration certificate. The judge's ruling against the couple came down after a three-hour hearing — but that didn't dampen the mood of many of the hundreds of young Chinese who gathered outside the courthouse hoping for a chance to "witness history," in the words of one supporter. |

Clinton: Americans should put Court nomination at forefront

Hillary Clinton wants voters to consider what Republican front-runner Donald Trump might do to shape the Supreme Court.
Clinton planned to use in a speech in Madison, Wisconsin, on Monday to argue that Trump could roll back the rights of individuals, further empower corporations and undo some of the nation's progress.
Clinton was campaigning in Wisconsin ahead of the state's April 5 primary and speaking Monday at the University of Wisconsin about President Barack Obama's nomination of Judge Merrick Garland.
Clinton holds a large lead among delegates against Democratic rival Bernie Sanders but is trying to stamp out the Vermont senator's momentum following his victories in five of the last six states holding contests.
Clinton's campaign said ahead of the speech that the Democratic presidential candidate would call on Senate Judiciary Chairman Charles Grassley of Iowa to commit to giving Garland a hearing. Grassley and Senate Majority Leader Mitch McConnell, R-Ky., have said that the late Justice Antonin Scalia should not be replaced until the next president picks a nominee.

Texas man executed for killing city code enforcement worker

A Texas man on death row for killing a worker who was on his property looking for city code violations was put to death Tuesday.
Adam Ward was given a lethal injection for shooting and killing Michael Walker, a code enforcement officer who was taking photos of junk piled outside the Ward family home in Commerce, about 65 miles northeast of Dallas.
Ward insisted the 2005 shooting was in self-defense, but the 44-year-old Walker only had a camera and a cellphone.
Ward's attorneys, both at his trial and later for his appeals, described him as delusional and mentally ill. Hours before his execution, the U.S. Supreme Court rejected an appeal that argued his mental illness should have disqualified him from the death penalty.
The 33-year-old Ward thanked his supporters, expressed love for his parents who did not attend the execution and said he hoped "some positive change can come from this."
But he insisted the shooting was not a capital murder case.
"This is wrong what's happening," he said. "A lot of injustice is happening in all this. I'm sorry things didn't work out. May God forgive us all."
He was given a lethal dose of pentobarbital and as it took effect, he took a deep breath followed by a smaller one. He then stopped moving.
He was pronounced dead at 6:34 p.m. CDT — 12 minutes after the drug started to flow into him.
Ward became the ninth convicted killer executed this year nationally and the fifth in Texas, which carries out capital punishment more than any other state.
In their appeal to the Supreme Court, Ward's attorneys argued the high court's ban on executing mentally impaired prisoners should be extended to include inmates like Ward who have a severe mental illness and that putting him to death would be unconstitutional because of evolving sentiment against executing the mentally ill.
The justices have ruled mentally impaired people, generally those with an IQ below 70, may not be executed. However, the court has said mentally ill prisoners may be executed if they understand they are about to be put to death and why they face the punishment.

Man accused of terrorism charge with fiancee pleads guilty

In fresh details provided as a young Mississippi man pleaded guilty to a terrorism-related charge, federal prosecutors said his fiancee led him toward a plan to travel to Syria to join the Islamic State.
Muhammad Dakhlalla, 23, pleaded guilty Friday in Aberdeen to providing material support to terrorism and faces up to 20 years in prison, $250,000 fines and lifetime probation. U.S. District Judge Sharion Aycock hasn't set his sentencing date yet.
His fiancee, Jaelyn Delshaun Young, is set for trial June 6 before Aycock. Plea agreements typically require cooperation with federal prosecutors, so Dakhlalla's plea makes it likely that he would testify against Young if a trial proceeds.
Both remain jailed without bail in Oxford.
A five-page statement of facts added new details about Young's conversion to Islam and her influence on Dakhlalla, who had been raised as a Muslim. The pair at one point planned to claim they were going on their honeymoon while traveling to Syria.
Young, a sophomore chemistry major at Mississippi State University at the time of her arrest, is the daughter of a school administrator and a police officer who served in the Navy reserve. She was a former honor student, cheerleader and homecoming maid at Vicksburg's Warren Central High School.

Conservative and liberal groups are only beginning their battle over the Supreme Court vacancy, with a smattering of television ads and behind-the-scenes research serving as warning shots in what's sure to be an expensive fight that will color November's elections.
Activity will only ramp up once President Barack Obama names someone to replace the late Justice Antonin Scalia ? a nomination Senate Majority Leader Mitch McConnell, R-Ky., and other Republicans promise the chamber will never consider. Many expect Obama to announce his pick next week.
With the court's 4-4 balance between liberal and conservative justices in play, both parties and their allies are reaching out to rally their memberships, solicit contributions and savage the opposition.
The conservative Judicial Crisis Network has run TV spots backing GOP senators in seven states and digital ads targeting Democrats in four others, while its leader wrote an article criticizing one potential nominee for a case she handled as a public defender a decade ago. On its website, the legislative arm of the National Rifle Association links readers to an article titled "Justice Barack Obama?" suggesting that scenario should Democrat Hillary Clinton become president.
The Senate Majority PAC, backing Democrats, has launched a New Hampshire TV ad accusing GOP Sen. Kelly Ayotte, in a competitive re-election race, of "ignoring the Constitution, not doing her job." And Citizens United, dedicated to overturning the Supreme Court decision that unleashed unlimited campaign spending by corporations and unions, has aired commercials pressing Ayotte and Sen. Roy Blunt, R-Mo., to consider a nominee. A group of 21 Democratic attorneys general penned a letter warning Senate leaders not to "undermine the rule of law." MoveOn.org and other progressive groups plan rallies outside senators' home-state offices on a March 21 "National Day of Action."
"A Supreme Court nomination is the No. 1 top priority for almost any conservative group," said Carrie Severino, the Crisis Network's policy director, a sentiment shared by liberals, too. "Almost every issue ultimately finds its way to the Supreme Court."
Democrats and liberals have focused on Senate Judiciary Committee Chairman Charles Grassley, R-Iowa, and other Republican senators seeking re-election this fall in swing states like Ohio, Pennsylvania and Wisconsin. Backed by nearly all GOP senators, Grassley has said his panel won't hold a hearing on Obama's choice. |
