A man will plead guilty to securities fraud and pay regulators around $801,000 for using insider information to profit from Disney's $4 billion acquisition of Marvel Entertainment in 2009.
According to the deal filed in Los Angeles federal court Wednesday, Toby Scammell learned from his then-girlfriend, a Disney corporate strategy employee, that Disney would acquire a well-known company she didn't name.
Scammell learned from his consulting company that Disney had previously wanted to acquire Marvel. He bought call options in Marvel stock for around $5,500, and later sold them for $192,000 in profit.
Last month, Scammell agreed to settle a parallel civil case and pay $801,000 to the Securities and Exchange Commission, which will be credited to his fine in the criminal case. He also faces prison time. |

SC Supreme Court hears appeal in fatal dog attack

Prosecutors want South Carolina's highest court to reinstate the conviction of a Dillon County man whose dogs attacked and killed a 10-year-old boy in 2006.
The state Supreme Court on Tuesday hears an appeal in the case of Bentley Collins. In 2012, the state Court of Appeals overturned Collins' involuntary manslaughter conviction and prison sentence, ruling a judge shouldn't have allowed prosecutors to show pictures of the boy taken before his autopsy.
The photographs showed the extent of the boy's injuries, including how the dogs mauled him so badly his bones were exposed and his ears and nose were eaten.
The judges said the pathologist testified to the injuries, so the photographs did nothing more than rile the jury's emotions.

Court rejects new cases on birth control coverage

The Supreme Court has turned away an early look at a challenge by religiously affiliated not-for-profit groups to the new health care law's provision on birth control coverage.
Lawsuits filed by the Roman Catholic Archdiocese of Washington and others are making their way through the courts. The justices on Monday declined to weigh in on them before any federal appeals court has reached a final decision.
The Obama administration has devised a compromise to the law's requirement that contraception be included in health plans' preventive services for women. The compromise attempts to create a buffer for religiously affiliated hospitals, universities and social service groups that oppose birth control. Their insurers or the health plan's outside administrator would pay for birth control coverage and creates a way to reimburse them. |
